Booster Seat Law (Grace Period Ending)

(Madisonville, Ky.) -- On July 15, 2008, legislation for a new, child booster seat law went into effect in Kentucky. The new requirements are part of KRS 189.125, which sets forth guidelines for child safety seats, booster seats and seat belts. The new law requires that any child between 40 and 50 inches tall and under the age of 7 to be placed in a booster seat.

On July 15, 2008, law enforcement began issuing courtesy warnings to those who did not have their children in booster seats. Courtesy warnings will be issued through June 30, 2009. Effective July 1, 2009, violators can be fined $30.00 for booster seat violations. If the violator provides proof of purchase or acquisition of a booster seat, the court may waive the fine.

Important things to remember:

• any child between 40 and 50 inches tall and under the age of 7 must be in a booster seat
• any child under 40 inches tall must be in an infant/child seat
• all children over the age of 7 and 50 inches tall must be secured in a seat belt
