News Release

Fatal Collision in Trimble County
Driver charged with Manslaughter

Date of News Release: 11/12/2008

(Campbellsburg, KY) - On November 11th, 2008, at approximately 4:44 pm, Kentucky State Police Post 5, Campbellsburg dispatchers received an injury accident report. The accident happened in the 6800 block of US Highway 421-North, approx. 2.5 miles South of Milton, adjacent to "Midway Stop and Go" convenient store. Upon emergency crews arrival, they found one subject deceased at the scene, and several more were injured. Preliminary investigation has revealed that a 1999 Mercury, driven by Herberto Rodriguez, 32, of Bedford, Ky., was northbound on US Hwy. 421-North, and was attempting to turn west into the parking lot of the convenient store. A 2000 GMC pickup, driven by Lori Howdyshell of Milton, Ky., was southbound on US Hwy. 421-North, was unable to avoid impacting the Mercury on the passenger side. Trimble County Deputy Coroner Bill Henderson pronounced a rear seat passenger, Jose Luis Benitez, 32, of Milton, Ky., dead on the scene. Also in Rodriguez vehicle was Julio Hernandez, 34, from Milton, Ky., who received minor injuries, and Sixto Hernandez, 20, from Milton, Ky., who also received minor injuries. Howdyshell received minor injuries as well, and all of the injured were transported to Kings Daughters Hospital in Madison, Indiana, to be evaluated and treated. Rodriguez received minor injuries and was transported to Carroll County Memorial Hospital for treatment. He was later arrested and charged with DUI 1st offense-Aggravated and Manslaughter 2nd degree, and lodged at the Carroll County Regional Detention Center. No one in the Rodriguez vehicle was wearing a seatbelt, however Howdyshell was wearing hers. Tpr. Charlie Kelton is the investigating officer. He was assisted on scene by the Deputy Coroner, Trimble County Paid EMS, Milton Fire Dept., Bedford Fire Dept., KSP Det. Kevin Johnson and Det. Steve Goodale.
