Arrest Made CVE Investigation

Date of News Release: 06/24/2011

(Morehead, Ky.) -- At 12:30 PM on June 18, 2011 Sgt. Michael Simpson of the Richmond sector observed a commercial vehicle traveling southbound on I-75 at approximately the 87 mile marker in the left commercial vehicle restricted lane. A traffic stop was initiated and a safety inspection started. After receiving all of the driver's paperwork, Sgt. Simpson discovered that the driver, Darryl D.Towne of Timco Logistics Systems Inc, had been operating for 20.5 hours without a qualified break. Mr. Towne was also unable to produce a medical certificate. Sgt. Simpson placed Mr. Towne out of service for 8 hours for exceeding his allowed hours of service and explained where he wanted him to park his vehicle and spend the 8 hours. Mr. Towne was escorted to a safe location off exit 87 and was advised not to drive for any reason since he could be arrested for the violation. Approx. 15 minutes later Sgt. Simpson observed Mr. Towne traveling south on I-75 at the 87 mile marker and initiated another traffic stop. Mr. Towne advised he was going to find a motel at another exit. Sgt. Simpson placed him under arrest for driving a commercial vehicle after he was declared out of service and was lodged in the Madison County Detention Center. The commercial vehicle was towed by Barger's wrecker's service. Mr. Towne was charged with Operating in a CMV restricted lane, No Medical Certificate in driver's possession and Driver operating CMV while Out of Service.
