Single vehicle non-injury accident leading to arrest on multiple drug charges

(Morehead, Ky.) -- On December 13th, 2011, at 3:02 p.m., Kentucky State Police were notified of a single vehicle accident on KY 557 in Elliott County. Trooper Royce Collett arrived on scene and observed that the operator of the vehicle, Rufus D. Burton, appeared to be under the influence of an intoxicant. Trooper Collett also detected a strong smell of marijuana coming from the 2000 Dodge Avenger wrecked into a tree. A search of the vehicle revealed a large bag that contained several baggies of marijuana, marijuana seeds, empty baggies, marijuana pipes, two sets of digital scales, and a small, loaded, .25 caliber handgun. Additionally a marijuana joint was located in a cigarette pack in Mr. Burton's pocket. Mr. Burton was arrested and charged with Operating Motor Vehicle Under Influence Alcohol/Drugs 1st, Failure to Wear Seat Belts, Failure of Non-owner Operator to Maintain Required Insurance 1st, Failure to Register Transfer of Motor Vehicle, Trafficking in Marijuana (8 oz to < 5 lbs) 1st Offense (Felony), Drug Paraphernalia- Buy/Possess, Possession of a Controlled Substance 2nd Degree 1st Offense (Drug Unspecified), and Possession of Marijuana. Mr. Burton was transported to the Big Sandy Detention Center by the Elliott County Jailer. Mr. Burton was the only occupant of the wrecked vehicle and sustained no injury. The accident and criminal arrest remain under investigation by Trooper Royce Collett.
