Update to the Seizure of Illegal Gambling Devices

(Barbourville, Ky.) -- On 12/14/2010 Kentucky State Police Post 10 Harlan received a court order from Knox Circuit Court to return gambling devices to Parkway Fuel Plaza that were seized on 01/07/10 for gambling purposes. The Kentucky Revised Statute 528.020 Promoting Gambling in the First Degree states - A person is guilty of promoting gambling in the first degree when he knowingly advances or profits from unlawful gambling activity by setting up and operating a gambling device. Promoting gambling in the first degree is a Class "D" felony.

Kentucky State Police Post 10 Harlan has received numerous complaints from the public in reference to illegal gambling devices that are in use across the Post 10 area of Knox, Bell and Harlan Counties. After multiple lengthy investigations and numerous state police manpower hours, Post 10 Commander Captain Leslie Smith stated, "We are very disappointed in the outcome of this case but we will continue to enforce the laws of the Commonwealth of Kentucky."

On 12/21/2010, Troopers from Kentucky State Police Post 10 Harlan turned over the gambling devices to the Parkway Fuel Plaza per court order. Further cases are pending in this investigation where a total of 49 machines were seized along with $62,277.00 in cash. As of 12/21/2010, $36,011.00 that was seized in these cases, have already been returned per court order from Knox Circuit Court to the businesses that were involved in this investigation.

(Barbourville, Ky.) -- On 1/7/2010 at 3:00 pm, Kentucky State Police Post 10 Harlan executed several search warrants at multiple businesses across Knox and Bell Counties in an effort to stop the promotion of illegal gambling. The businesses involved were; Knox County - Flat Lick BP, Creek Mart at Flat Lick, Spur #1 in Barbourville, Williams Stop and Go in Barbourville, Spur #2 at Bailey Switch, Heidrick One Stop. In Bell County - Exxon Friendly Mart in Pineville. A total of 49 illegal gambling devices were seized along with $62,277.00 in cash. Charges are pending.

These cases are still under investigation by Detective Keith Saylor and Trooper Tyson Lawson of Kentucky State Police Post 10 Harlan.
