Physical Altercation with Officers

(Elizabethtown, Ky.) -- On October 29, 2009 at 1827 hours, Tpr. Jack Baumgardner and Tpr. Arthur Baetzel responded to a domestic complaint at 160 Eagle Pass Road in Hardin County. Robert Hovious, 47 of Elizabethtown, was at the residence, intoxicated, and threatening other family members. Tpr. Baumgardner arrived and observed the subject standing outside the residence on the front porch. As Tpr. Baumgardner approached the subject, the subject, without provacation, made a threat to cause physical harm to Tpr. Baumgardner. Tpr. Baumgardner issued several verbal commands to the subject to turn around and place his hands behind his back. The subject failed to comply with the commands and made a second threat towards Tpr. Baumgardner. Tpr. Baumgardner then administered a burst of OC pepper spray to the subject. The subject became more combative and a struggle ensued. Tpr. Baetzel then arrived and both units were able to handcuff the subject without further incident. The subject was charged with Alcohol Intoxication in a Public Place 1st Offense, Menacing, Criminal Trespassing 3rd Degree, and Resisting Arrest. The subject was lodged in the Hardin County Detention Center.
