Felony Arrest in Dawson Springs, KY

Madisonville, KY - On June 15, 2008, the 14 year-old daughter of Derek Hammons was operating an ATV in and around the residence of her father on Shellie Poe Road in Dawson Springs. She had two passengers on the ATV with her while she was operating it. Peyton Phelps, a 5 year-old male, was behind her and Alexander Masoncup, a 2 year-old male, was in front of her. While traveling on Shellie Poe Road which is a paved county road, Peyton Phelps fell from the back of the ATV and sustained multiple injuries. Neither Derek Hammons nor Amanda Masoncup was in the direct area supervising the children. Both allowed Hammons daughter to ride the ATV with passengers despite the manufacturer's warning stickers on the ATV and the violation of the KRS (Kentucky Revised Statutes). The ATV involved was clearly marked with manufacturer's stickers that advised no operator's under 16, no passengers, and to always wear a helmet. Warrants for Derek Hammons and Amanda Masoncup were obtained from the Hopkins County Attorney's Office by Tpr. Komar. Both subjects were arrested and charged with Wanton Endangerment 1st Degree (2 counts)-Class D Felony. They were lodged in the Hopkins County Detention Center.
