Recovery and Identification of Human Remains

(Harlan, KY) - On 5/6/2003 at 8:17 PM, the Wayne County Sheriff's Department received a 911 call that human remains were located by two fisherman near the Harmon Creek area of Lake Cumberland in Wayne County.

Wayne County Sheriff James Hill, Wayne County Coroner Marvin Hicks and the Wayne County Rescue Squad responded to the scene and recovered the remains and sent them to the Kentucky Medical Examiners Office in Frankfort, KY for identification.

The remains were identified by Dr. Emily Craig as being that of Timothy A. Sizemore by using spinal x-ray comparison.

Tim Sizemore was reported missing on 7/3/96 and after further investigation by Kentucky State Police Post 10 Detective K.Y. Fuson, an arrest was made on Carlton Foley on 7/11/96.

Carlton Foley was charged with Murder and Robbery and was convicted in Laurel Circuit Court on 11/12/97. Foley was sentenced to 20 years for murder and 20 years for robbery with both charges to run consecutively. Carlton Foley is currently serving his sentence at the Green River Correctional Complex.

The remains of Tim Sizemore were unknown until they were recovered on 5/6/2003. This case remains open and is still under investigation by Detective K.Y. Fuson, Kentucky State Police Post 10 Harlan.
