Kentucky State Police Crack Down on Non-Compliant Registered Sex Offenders

FRANKFORT, Ky. (January 9, 2006) - For the past few months, the Kentucky State Police has quietly gone about locating registered sex offenders who are in violation of Kentucky's registered sexual offender laws. Specifically, the law requires offenders to report any address change to their local Probation and Parole office prior to actually moving. If an offender moves without following proper procedure, and it is discovered, then he/she is considered to be "Non-Compliant" and is subject to being charged with a Class D Felony, punishable by 1-5 years in prison. Troopers from 15 posts across the state participated in the investigation. Post 3 Bowling Green was the only post without any non-compliant registrants.

Over the past few months the Kentucky State Police identified 101 individuals reported "non-compliant" by the Sexual Offender Registry.

Of the 101:

  • 20 were found (19 in correctional facilities and one with an improperly recorded address),
  • 31 have been charged with "Failure to Comply with Sex Offender Registration", a Class D Felony punishable by 1-5 years in prison,
  • Seven (7) cases are pending grand jury action, and
  • 43 non-compliant offenders are still being investigated to determine their whereabouts.

Post 12 Frankfort detectives initiated a program to check on all sex offenders that are registered in the Post 12 area (excluding Fayette County). They are in the process of physically verifying the addresses of 167 registered sex offenders listed on the KSP Website. They have currently discovered seven (7) violators as a result of this new initiative and expect to discover more before this project is completed.

"If you suspect an offender has moved from the address listed on the web site, you should report this suspected violation to the Kentucky State Police so that an investigation may be conducted," recommends Lt. Col. Dean Hayes, KSP Director of Operations. "Although Kentucky has a non-compliance rate of only 2.5% (one of the lowest nationwide), the Kentucky State Police remain committed to locating those offenders and pursuing criminal charges for those violating Kentucky law," advises Hayes.

Improvements have been made to a notification system regarding incarcerated offenders to provide for automatic notification to the Sex Offender Registry program when a registered offender is jailed.

To date, there are 5,453 offenders listed on the registry. Of the listed offenders, 139 are currently non-compliant. The Sex Offender Registry can be located at http://kspsor.state.ky.us/. Searches of registered sex offenders can be done by name, county or zip code.

Registered offenders report their address to the Department of Corrections prior to their release from prison, or the Division of Probation & Parole upon being assigned probation or moving in from another state. The information is collected on a standard Offender Registration form, which the offender must sign, and is then forwarded to the Kentucky State Police for inclusion in the database and placement on the web site.

The address verification procedure is conducted by sending "Certified" address verification forms to the offenders registered address, which they must sign and return within 10 days.

Failure to respond to the letter places the offender in "Non-Compliance" and local authorities are notified of the possible violation. Lifetime registrants have their addresses verified every 90 days, while Ten-Year registrants are verified annually.
